Sumchat Copyright & Content Complaints Policy

Sumchat hosts workspaces and websites operated by our customers. This policy explains how to report content on Sumchat-hosted services that you believe infringes your copyright or otherwise violates the law or our Acceptable Use Policy, and what we do about it.

1. Copyright infringement (DMCA)

We respond to notices of claimed copyright infringement under the Digital Millennium Copyright Act, 17 U.S.C. § 512, for material stored on our systems at the direction of our customers.

Filing a takedown notice

Send a written notice to the agent above including all of the following (17 U.S.C. § 512(c)(3)):

  1. your physical or electronic signature (or that of a person authorized to act for the owner);
  2. identification of the copyrighted work you claim is infringed (or a representative list);
  3. identification of the material you claim is infringing and information reasonably sufficient to let us locate it; the specific URL(s);
  4. your contact information (name, address, telephone number, email);
  5. a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and
  6. a statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of the exclusive right allegedly infringed.

Please note: under § 512(f), a person who knowingly materially misrepresents that material is infringing may be liable for damages. Consider whether the use is a fair use before filing.

On receiving a substantially compliant notice, we act expeditiously to remove or disable access to the material, notify the customer responsible for it, and record the notice for our repeat-infringer accounting.

Counter-notices

If your material was removed and you believe that was a mistake or misidentification, you may send the agent a written counter-notice including: your physical or electronic signature; identification of the removed material and where it appeared; a statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification; your name, address, and telephone number; and a statement that you consent to the jurisdiction of the federal district court for your address's judicial district (or, if outside the United States, any judicial district in which Sumchat may be found) and that you will accept service of process from the person who filed the original notice or their agent.

We forward valid counter-notices to the original complainant. Unless they notify us within 10 business days that they have filed a court action seeking to restrain the activity, we restore the material within 10–14 business days of receiving the counter-notice.

Repeat infringers

We terminate, in appropriate circumstances, the workspaces of customers who are repeat infringers. We keep a strike record per workspace of substantiated infringement notices (takedowns not resolved by a successful counter-notice); accumulated strikes lead to escalating enforcement up to termination, and we consider the circumstances, including whether infringement is the workspace's purpose; in deciding when termination is appropriate.

2. Scope note: AI-generated content

The DMCA process above applies to material stored at the direction of our customers. If your complaint is that content generated by Sumchat's AI features infringes your rights or misuses your name, voice, or likeness, you may use the same contact (copyright@sumchat.ai); we review those complaints directly, outside the § 512 lane, and act on them under our AUP, including its prohibitions on imitating real people and brands. California residents may also invoke Civil Code rights regarding AI-generated replicas of name, voice, or likeness; we honor takedown obligations applicable to such content promptly.

3. Trademark and other complaints

For trademark complaints, identify your mark, its registration (if any), the allegedly infringing material's URL, and the confusion you believe results; send to legal@sumchat.ai. For any other unlawful content; defamation with a court order, privacy violations, non-consensual imagery; use abuse@sumchat.ai or the report link available on published sites. Non-consensual intimate imagery and CSAM are handled with priority: CSAM is removed and reported to NCMEC immediately.

4. How enforcement works

A person reviews every complaint. Our remedies run from removing specific content, to unpublishing a site, to suspending or terminating a workspace, per Terms §§ 8.7, 12–13; we use the narrowest remedy that resolves the problem, we notify the affected customer and give them a chance to respond where law and safety allow, and we do not disclose reporter contact details to the reported customer except as the DMCA process requires or law compels.
